GENERAL

Modern Methods of Mobility is a brand by Motion Impulse Ltd and is registered in Dublin, Ireland.

Please read these Terms and Conditions carefully before using the modernmobility.com website (the “Service”) operated by Modern Methods of Mobility (“us”, “we”, or “our”). These terms and conditions govern the way in which we supply our online learning products to you. 

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. 

Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. All rights not expressly granted in these terms are hereby reserved. 

You agree to review this agreement periodically to ensure that you are aware of any amendments to this agreement, which may be made at any time. 

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

GRANT OF LICENCE

After you have completed the payment for the respective Modern Methods of Mobility online programs, we hereby grant you a licence to use the purchased product (“course” or “program”). This licence is limited, revocable, non-exclusive, non-sublicensable and non-transferable, and is subject to the rights and obligations granted under these Terms. This licence is personal to you and cannot be shared or exchanged with others.

ACCESS TO MATERIALS

We grant access to all products on Modern Methods of Mobility as per your licensing set out in these terms. However, please be aware that access may be restricted due to maintenance on the website or other unforeseen circumstances related to third party providers beyond our control. We agree to ensure that restrictions in access are as minimal as commercially viable. 

The purchase of one product does not grant you access to any different modules/programs (present or future) of the Modern Methods of Mobility syllabus. If new programs are added to Modern Methods of Mobility, these will be up for sale on the website separately. 

Please note that access to any purchased product will only be granted after we have received your payment in full. 

We may restrict your access to any purchased products if you breach these terms, including without limitation: 

1. a) Failure to make any payment due to us; or 
2. b) Failure to provide accurate information that is necessary for us to provide the Products to you. 

In these circumstances, we reserve the right to restrict your access to any product without further notice.

PURCHASES, PRICING AND PAYMENT

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your country of residence and credit card issuing country (in accordance to the EU VAT regulation) and your email address. 

When placing an order, you agree to sign up for our newsletter. You may unsubscribe at any time. 

We use Stripe as third party payment provider. Payment for the products must be made at the point of purchase. You agree to provide payment for the Products in Euro (€) currency and you will be liable to pay any relevant conversion charges, as well as applicable sales tax in your region. 

The Modern Methods of Mobility programs are one payment only products respectively, and your initial payment includes the licensing of the purchased product for an unlimited period of time with no ongoing or future costs. 

We reserve our right to review and change the pricing of any of our products. This will not affect products that have already been purchased. 

As per the VAT standard of the EU we are obligated to charge VAT at the rate that applies in Ireland if you are a resident in the EU. A customer’s location needs to be proved using two non-conflicting pieces of proof. We determine the location using (1) Credit card country and (2) Country from the billing details page.

UPDATES TO PURCHASED PRODUCT

Our aim is to provide courses and materials of the highest quality. As such, improvements or changes to the Modern Methods of Mobility programs or any other materials may occur at any time without prior notification. We reserve the right to continually update and change any of the available programs of Modern Methods of Mobility. Once any of these products has been purchased, your licence will stay vaild regardless of updates, upgrades and changes made to the content of the program. The amended product will automatically become available for you to use in your account.

CANCELLATION POLICY AND REFUNDS 

Where an online product is delivered to you immediately, you will not have the right to return the purchased product. 

It is your responsibility to ensure that you meet the system requirements, including compatible hardware, software, and internet service, prior to purchasing any content. We are unable to provide refunds where your access to the Products is inhibited due to insufficient system requirements. 

It is also your responsibility to ensure you meet the physical requirements for your chosen program. We cannot refund due to too high or too low skill or physical preparation levels required for all Modern Methods of Mobility programs respectively. 

We are unable to provide a refund except at our absolute and sole discretion.

INTELLECTUAL PROPERTY

All rights, title and interest in intellectual property rights relating to Modern Methods of Mobility Products shall exclusively be owned by Emmet Louis and Motion Impulse Ltd. While you may utilise the intellectual property, you understand that there shall be no transfer of ownership of the same. Nothing that you see or read in the Products may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use. All other trademarks, service marks and trade names in this material are the marks of the respective owners and any unauthorised use is prohibited.

DATA PROTECTION AND PRIVACY

We take your privacy very seriously and commit to protect all personal information transferred to us in the process of using our Service. 

You agree to review and accept our Privacy Policy outlined here.

LINKS TO 3RD PARTY WEBSITES & SERVICES

Our website may contain links to third-party websites or services that are not owned or controlled by Modern Methods of Mobility. 

Modern Methods of Mobility has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Modern Methods of Mobility shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

CHANGES TO THESE TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

MODERN METHODS OF MOBILITY SEMINARS

Modern Methods of Mobility offers international weekend seminars.

If you would like to cancel your already booked and paid spot on a Modern Methods of Mobility seminar, please consider first if you can transfer your registration to someone else. You can also get in touch and ask whether there is a waiting list for this particular event. For this, simply drop us an email at info@modernmobility.com with the following information: The seminar date and location, your name and the persons name that will take your place as well as the new attendees email address. 

There will be no refund on withdrawal from a seminar if notification is received less than three months prior to the scheduled date of the event.

In the case of an injury or sickness preventing you from taking part in the seminar, you will be able to receive a refund up until the retreat, provided you send us a doctors note attesting to your circumstances. You will receive a refund minus a 50€ administration charge. 

In the event of a cancellation of a seminar, a full refund will be given of all sign ups of the cancelled event. Motion Impulse and the workshop presenters take no responsibility for non refundable travel and accommodation expenses. Please make sure to wait until final event confirmation to book any non refundable travel. 

Modern Methods of Mobility takes no responsibility for loss of, or damage to, personal belongings, injuries or similar. We advise you to always have travel insurance when you travel to any events abroad.
